xAI's Memphis expansion shows AI's energy fights are now legal fights

A federal judge has let the NAACP's Clean Air Act case over xAI's Southaven turbines proceed, over the Justice Department's objection.

xAI powers its Colossus 2 data centre in South Memphis partly with gas turbines across the state line in Southaven, Mississippi. Mississippi's Department of Environmental Quality issued an air permit for 27 turbines in March 2026. The NAACP, represented by the Southern Environmental Law Center and Earthjustice, sued in April over turbines operated before that permit was issued.

On October 19, 2026, Judge Debra Brown of the U.S. District Court for the Northern District of Mississippi denied the Justice Department's motion to dismiss the case. The ruling does not decide whether the company broke the law.

ESS view: power, permits and community consent are now on the critical path for AI infrastructure, as they are for electric bus depots. Projects that plan for them early move faster.
