A consolidated operator market puts the leverage in the contract

Transdev's 2023 purchase of First Transit created the largest private operator of US public transportation. Agencies' leverage now sits in what they write into contracts.

Transdev completed its acquisition of First Transit on March 7, 2023, describing the combined business as about 32,000 employees and 17,300 vehicles serving 400 communities in 43 states, Washington, D.C. and Puerto Rico.

For agencies that contract out bus and paratransit service, that consolidation narrows the field of national bidders for each recompete.

ESS view: when fewer large operators compete, an agency's leverage comes from the contract itself: clear performance measures, ownership of operating data, and the information a new operator needs to take over service smoothly.
